Wishtide Terms of Service

Welcome to Wishtide. These Terms of Service ("Terms") set out the rules for using the Wishtide website, mobile experience, and related services ("Wishtide", "the platform", "we", "us", "our"). Please read them carefully before using Wishtide.

By creating an account or using Wishtide, you confirm that you meet the eligibility requirements below and agree to comply with these Terms.

If you do not agree to these Terms, you must not use Wishtide.

Who We Are

Wishtide is operated by WISHTIDE TECHNOLOGIES LTD, a company registered in the United Kingdom under company number 16930589. Our registered office details are available on the UK Companies House register. When we refer to "Wishtide", "we", "us" or "our" in these Terms, we are referring to WISHTIDE TECHNOLOGIES LTD.

1. About Wishtide

Wishtide is a platform that allows users to create, manage, and share wishlists, track items, and interact with features designed to help you organise and fulfil your wishes.

These Terms apply to all users of the platform.

2. Eligibility

To use Wishtide, you must:

  • Be at least 16 years old; and
  • Have the legal capacity to enter into a binding agreement under the laws of your country of residence; and
  • Use the platform in compliance with these Terms and applicable laws.

If you are under 18, you may only use Wishtide with the permission and supervision of a parent or legal guardian, who is responsible for your use of the platform.

Age requirement for receiving contributions

To enable contributions on your wishlists and receive payouts, you must complete identity verification through our payment provider, Stripe. Stripe requires all account holders who receive payouts to be at least 18 years old. If you are aged 16 or 17, you may use Wishtide and contribute to others' wishlists, but you will not be able to enable contributions on your own wishlists or receive payouts until you turn 18 and successfully complete Stripe's verification process.

3. Your Account

You are responsible for:

  • Keeping your login details secure
  • All activity that occurs under your account
  • Ensuring your information is accurate and up to date

We may suspend or terminate your account if we believe it has been compromised or used in violation of these Terms.

4. Acceptable Use

You agree not to:

  • Use Wishtide for unlawful, harmful, or fraudulent purposes
  • Upload or share content that is abusive, hateful, defamatory, or infringing
  • Attempt to access accounts or systems without permission
  • Interfere with the operation or security of the platform
  • Use automated tools (bots, scrapers) without our written consent

We may remove content or restrict access if we believe these rules are violated.

5. Your Content

You may create and upload content such as wishlists, events, notes, images, links and profile information ("Your Content").

Wishtide is a sharing and social platform. Depending on the settings you choose, Your Content may be visible to other users or to anyone with a shareable link. You are responsible for choosing the appropriate visibility settings and for not including sensitive personal information in public or widely shared content.

By submitting or uploading Your Content to Wishtide, you grant us a non‑exclusive, worldwide, royalty‑free licence (with the right to sublicense to our service providers) to:

  • Host, store and back up Your Content;
  • Display and make Your Content available to you, to other users and to members of the public, according to the visibility and sharing settings you choose;
  • Reproduce, adapt and format Your Content as necessary to operate, maintain, promote and improve Wishtide (for example, to generate thumbnails, adjust layouts or surface recommendations within the platform); and
  • Use Your Content in anonymised or aggregated form to analyse how features are used and improve Wishtide.

This licence exists for as long as Your Content is available on Wishtide. If you delete Your Content or close your account, we will stop displaying it, although copies may remain in backups or logs for a limited period, as described in our Privacy Policy.

You retain full ownership of Your Content. You are responsible for ensuring that:

  • You have all necessary rights and permissions to upload and share Your Content; and
  • Your Content does not violate any laws, these Terms or any third‑party rights (including privacy and intellectual property rights).

6. Our Content

All Wishtide branding, design, features, and intellectual property belong to us or our licensors.

You may not:

  • Copy, modify, or distribute our content
  • Reverse‑engineer or attempt to extract source code
  • Use our trademarks without permission

7. Payments

Some Wishtide features may require payment or a subscription, and in the future users may be able to make contributions or gifts in connection with wishlists or events.

Unless we say otherwise in a specific offer, Wishtide provides a platform that facilitates payments between users and does not itself sell or supply the underlying products, services or experiences listed in wishlists or events.

When you make a payment on Wishtide:

  • Payments are processed securely by our third‑party provider Stripe, and your card details are handled in accordance with Stripe’s own terms and privacy notice;
  • You must use a valid and authorised payment method that you are entitled to use;
  • We are not responsible for the quality, fulfilment, cancellation or delivery of any products, services or experiences arranged between you and another user or third party, unless we explicitly state that Wishtide is the seller; and
  • Refunds (where applicable) will be handled in accordance with UK consumer law and any additional terms we provide at the point of purchase.

If an organiser cancels an event or does not fulfil a wishlist item, any remedy or refund will generally be a matter between you and that organiser or third party, subject to any rights you may have under consumer protection law and any specific policies we may publish from time to time.

Receiving Contributions & Payouts

To receive monetary contributions on your wishlists, you must verify your identity through Stripe Connect, our payment provider. You must be at least 18 years old to complete this verification and receive payouts. This requirement is imposed by Stripe and applicable financial regulations, and applies regardless of the age at which you registered for Wishtide.

If you are between 16 and 17 years old, you may still use Wishtide and make contributions to other users' wishlists, but the option to receive contributions on your own wishlists will not be available until you are 18 and have completed identity verification.

Fees & Charges

When a contribution is made through Wishtide, the following fees are applied and are borne by the contributor (the person making the payment):

  • Wishtide platform fee: 5% of the contribution amount. This fee supports the operation and development of the Wishtide platform.
  • Payment processing fee: A fee charged by our payment processor, Stripe, to cover card transaction costs. This is calculated at 3.25% of the total transaction amount plus £0.20. This rate reflects the worst-case international card rate; domestic or EEA card transactions may be processed at a lower rate, but the quoted rate ensures Wishtide is never out of pocket on any transaction.

Both fees are added on top of the contribution amount you enter, so the recipient receives the full amount you intend to contribute. The total amount you will be charged (including all fees) will always be clearly displayed before you confirm any payment.

We reserve the right to update our fee structure. Any changes will be communicated in advance and reflected in an updated version of these Terms.

8. Third‑Party Services

Wishtide may integrate with third‑party tools (e.g., analytics, payment processors, social platforms).

We are not responsible for:

  • Their content
  • Their policies
  • Their availability

Your use of third‑party services is governed by their own terms.

9. Privacy

Your privacy is important to us.

Our Privacy Policy explains in detail how we collect, use and protect your personal data, and the rights you have under UK data protection law. Please read it carefully. Where we rely on your consent (for example, for optional analytics or marketing), we will ask you for that consent separately.

10. Cookies

Wishtide uses cookies and similar technologies.

Our Cookie Policy explains how cookies are used, which optional analytics and marketing cookies we use, and how you can manage your preferences or withdraw consent.

11. Termination

We may suspend or terminate your access to Wishtide if:

  • You violate these Terms
  • You misuse the platform
  • We are required to do so by law

You may delete your account at any time.

Upon termination:

  • Your right to use Wishtide ends; and
  • We may retain certain data as required by law or for legitimate business purposes, in line with our Privacy Policy (for example, to comply with legal obligations, resolve disputes and prevent fraud).

12. Disclaimers

Wishtide is provided "as is" and "as available".

We do not guarantee:

  • Uninterrupted or error‑free service
  • That the platform will meet your expectations
  • That content will always be accurate or available

To the extent permitted by law, we disclaim all warranties.

13. Limitation of Liability

Nothing in these Terms is intended to exclude or limit any rights you have under consumer law, or our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited under applicable law.

Subject to the paragraph above, and to the fullest extent permitted by law, Wishtide is not liable for:

  • Loss of data
  • Loss of profits or revenue
  • Indirect or consequential damages
  • Issues caused by third‑party services

Subject to your statutory rights, our total liability to you arising out of or in connection with Wishtide and these Terms will not exceed the amount you paid to use chargeable Wishtide features in the previous 12 months (if any).

14. Changes to These Terms

We may update these Terms from time to time, for example to reflect changes to Wishtide, our business or the law. If we make material changes that significantly affect your rights or obligations, we will give you reasonable notice by email or by displaying a prominent notice in your account or on the platform.

Where a change is material and you do not agree with it, you may stop using Wishtide and close your account before the change takes effect. Your continued use of Wishtide after the updated Terms take effect will mean that you accept those changes.

15. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes will be resolved in the courts of England and Wales.

16. Badges & Achievements

Wishtide operates a Badges & Achievements programme that awards digital badges to users who meet certain criteria, such as early adoption, hosting events, contributing to wishes, or referring new members.

The following rules apply to all badges:

  • No monetary value. Badges are purely cosmetic digital recognitions. They have no cash value, cannot be transferred, sold, exchanged or redeemed for any monetary benefit or reward, and do not create any contractual entitlement.
  • Wishtide determines eligibility. We have sole and final discretion to determine whether a user has met the criteria for any badge. Our decision is final and not subject to appeal.
  • Criteria and availability may change. Badge criteria, names, descriptions and availability (including any stated limits, e.g. "Only 100 Available") are subject to change at any time. We will endeavour to give reasonable notice of significant changes, but we are not obligated to do so.
  • Limited-time badges. Some badges are only available during a defined window (such as our launch period). Wishtide determines when those windows open and close. Missing a window does not entitle you to any alternative badge or compensation.
  • Referral badges. Badges tied to referrals (such as "Influencer" or "Ambassador") depend on the independent actions of the users you refer. We cannot guarantee that referred users will complete the required actions, and no compensation or alternative badge will be awarded if they do not.
  • Right to revoke. We reserve the right to revoke a badge if we believe it was earned fraudulently, in violation of these Terms, or as a result of an error.
  • Programme changes. We may modify, suspend or discontinue the Badges & Achievements programme at any time without liability to you.
