Wishtide Terms of Service

Welcome to Wishtide. These Terms of Service ("Terms") set out the rules for using the Wishtide website, mobile experience, and related services ("Wishtide", "the platform", "we", "us", "our"). Please read them carefully before using Wishtide.

By creating an account or using Wishtide, you confirm that you meet the eligibility requirements below and agree to comply with these Terms.

If you do not agree to these Terms, you must not use Wishtide.


Who We Are

Wishtide is operated by WISHTIDE TECHNOLOGIES LTD, a company registered in the United Kingdom under company number 16930589. Our registered office details are available on the UK Companies House register. When we refer to "Wishtide", "we", "us" or "our" in these Terms, we are referring to WISHTIDE TECHNOLOGIES LTD.


1. About Wishtide

Wishtide is a platform that allows users to create, manage, and share wishlists, track items, and interact with features designed to help you organise and fulfil your wishes.

These Terms apply to all users of the platform.


2. Eligibility

To use Wishtide, you must:

  • Be at least 13 years old; and
  • Have the legal capacity to enter into a binding agreement under the laws of your country of residence; and
  • Use the platform in compliance with these Terms and applicable laws.

If you are under 18, you may only use Wishtide with the permission and supervision of a parent or legal guardian, who is responsible for your use of the platform.


3. Your Account

You are responsible for:

  • Keeping your login details secure
  • All activity that occurs under your account
  • Ensuring your information is accurate and up to date

We may suspend or terminate your account if we believe it has been compromised or used in violation of these Terms.


4. Acceptable Use

You agree not to:

  • Use Wishtide for unlawful, harmful, or fraudulent purposes
  • Upload or share content that is abusive, hateful, defamatory, or infringing
  • Attempt to access accounts or systems without permission
  • Interfere with the operation or security of the platform
  • Use automated tools (bots, scrapers) without our written consent

We may remove content or restrict access if we believe these rules are violated.


5. Your Content

You may create and upload content such as wishlists, events, notes, images, links and profile information ("Your Content").

Wishtide is a sharing and social platform. Depending on the settings you choose, Your Content may be visible to other users or to anyone with a shareable link. You are responsible for choosing the appropriate visibility settings and for not including sensitive personal information in public or widely shared content.

By submitting or uploading Your Content to Wishtide, you grant us a non‑exclusive, worldwide, royalty‑free licence (with the right to sublicense to our service providers) to:

  • Host, store and back up Your Content;
  • Display and make Your Content available to you, to other users and to members of the public, according to the visibility and sharing settings you choose;
  • Reproduce, adapt and format Your Content as necessary to operate, maintain, promote and improve Wishtide (for example, to generate thumbnails, adjust layouts or surface recommendations within the platform); and
  • Use Your Content in anonymised or aggregated form to analyse how features are used and improve Wishtide.

This licence exists for as long as Your Content is available on Wishtide. If you delete Your Content or close your account, we will stop displaying it, although copies may remain in backups or logs for a limited period, as described in our Privacy Policy.

You retain full ownership of Your Content. You are responsible for ensuring that:

  • You have all necessary rights and permissions to upload and share Your Content; and
  • Your Content does not violate any laws, these Terms or any third‑party rights (including privacy and intellectual property rights).

6. Our Content

All Wishtide branding, design, features, and intellectual property belong to us or our licensors.

You may not:

  • Copy, modify, or distribute our content
  • Reverse‑engineer or attempt to extract source code
  • Use our trademarks without permission

7. Payments

Some Wishtide features may require payment or a subscription, and in the future users may be able to make contributions or gifts in connection with wishlists or events.

Unless we say otherwise in a specific offer, Wishtide provides a platform that facilitates payments between users and does not itself sell or supply the underlying products, services or experiences listed in wishlists or events.

When you make a payment on Wishtide:

  • Payments are processed securely by our third‑party provider Stripe, and your card details are handled in accordance with Stripe’s own terms and privacy notice;
  • You must use a valid and authorised payment method that you are entitled to use;
  • We are not responsible for the quality, fulfilment, cancellation or delivery of any products, services or experiences arranged between you and another user or third party, unless we explicitly state that Wishtide is the seller; and
  • Refunds (where applicable) will be handled in accordance with UK consumer law and any additional terms we provide at the point of purchase.

If an organiser cancels an event or does not fulfil a wishlist item, any remedy or refund will generally be a matter between you and that organiser or third party, subject to any rights you may have under consumer protection law and any specific policies we may publish from time to time.


8. Third‑Party Services

Wishtide may integrate with third‑party tools (e.g., analytics, payment processors, social platforms).

We are not responsible for:

  • Their content
  • Their policies
  • Their availability

Your use of third‑party services is governed by their own terms.


9. Privacy

Your privacy is important to us.

Our Privacy Policy explains in detail how we collect, use and protect your personal data, and the rights you have under UK data protection law. Please read it carefully. Where we rely on your consent (for example, for optional analytics or marketing), we will ask you for that consent separately.


10. Cookies

Wishtide uses cookies and similar technologies.

Our Cookie Policy explains how cookies are used, which optional analytics and marketing cookies we use, and how you can manage your preferences or withdraw consent.


11. Termination

We may suspend or terminate your access to Wishtide if:

  • You violate these Terms
  • You misuse the platform
  • We are required to do so by law

You may delete your account at any time.

Upon termination:

  • Your right to use Wishtide ends; and
  • We may retain certain data as required by law or for legitimate business purposes, in line with our Privacy Policy (for example, to comply with legal obligations, resolve disputes and prevent fraud).

12. Disclaimers

Wishtide is provided "as is" and "as available".

We do not guarantee:

  • Uninterrupted or error‑free service
  • That the platform will meet your expectations
  • That content will always be accurate or available

To the extent permitted by law, we disclaim all warranties.


13. Limitation of Liability

Nothing in these Terms is intended to exclude or limit any rights you have under consumer law, or our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited under applicable law.

Subject to the paragraph above, and to the fullest extent permitted by law, Wishtide is not liable for:

  • Loss of data
  • Loss of profits or revenue
  • Indirect or consequential damages
  • Issues caused by third‑party services

Subject to your statutory rights, our total liability to you arising out of or in connection with Wishtide and these Terms will not exceed the amount you paid to use chargeable Wishtide features in the previous 12 months (if any).


14. Changes to These Terms

We may update these Terms from time to time, for example to reflect changes to Wishtide, our business or the law. If we make material changes that significantly affect your rights or obligations, we will give you reasonable notice by email or by displaying a prominent notice in your account or on the platform.

Where a change is material and you do not agree with it, you may stop using Wishtide and close your account before the change takes effect. Your continued use of Wishtide after the updated Terms take effect will mean that you accept those changes.


15. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes will be resolved in the courts of England and Wales.
